NOTICE BEFORE THE UNSAFE BUILDINGS COMMISSION OF THE CITY OF HUNTINGTON, CABELL AND WAYNE COUNTIES, WEST VIRGINIA IN RE: JOHN B. KENNEDY, ANDREW L. KENNEDY AND AMANDA N. KENNEDY 312 2ND STREET HUNTINGTON, WV 25701 PROPERTY: 312 2ND STREET HUNTINGTON, WEST VIRGINIA ORDER OF DEMOLITION On Thursday the 13th day of April, 2017, the Unsafe Buildings Commission of the City of Huntington came on for hearing as provided by Article 1739 of the codified Ordinances of the City of Huntington, as revised. After it first being determined that Notice was duly and properly given as provided by law, a majority of the Commission agreed that the structure located at 312 2nd Street, within the limits of the City of Huntington is unsafe, dangerous or detrimental to the public welfare and should be demolished. Therefore, it is hereby ORDERED that the structure located at 312 2nd Street within the limits of the City of Huntington be DEMOLISHED within thirty (30) days after entry of this Order pursuant to the provisions of Article 1739 of the Codified Ordinances of the City of Huntington, as revised. It is further ORDERED that the structure located at 312 2nd Street shall be SECURED and BOARDED within five (5) days after entry of this Order pursuant to the provisions of Article 1739 of the Codified Ordinances of the City of Huntington, as revised, until such time as the structure is demolished. It is further ORDERED that the property owners, John B. Kennedy, Andrew L. Kennedy and Amanda N. Kennedy, shall pay for all costs associated with the demolition of the structure located at 312 2nd Street, Huntington, West Virginia. It is further ORDERED that the City of Huntington shall have the right to file a lien against the real property located at 312 2nd Street, Huntington, West Virginia, or to institute civil action in a court of competent jurisdiction against the property owner or other responsible party for all costs incurred with respect to said demolition and for reasonable attorney's fees and court costs incurred by the City of Huntington in the prosecution of said collection of said costs relating to the demolition of the structure. Said lien, unless otherwise stated, shall accrue interest at the rate of ten percent (10%) per annum. It is further ORDERED that this Order of Demolition shall be served in accordance with the laws of this state concerning service of process of civil actions, and shall, in addition thereto, be posted in a conspicuous place on the premises affected by the Order of Demolition. A hearing before the Unsafe Buildings Commission of the City of Huntington on the question of whether the building is unfit for human habitation or is unsafe, unsanitary, dangerous or detrimental to the public welfare shall be held on Thursday, the 8th day of June, 2017 at 10:00 o'clock a.m. in the Huntington City Hall Council Chambers, 800 Fifth Avenue, Huntington, West Virginia, at which time you may be present to protect your interest, if you so desire. You may appear in person at the hearing or by agents or by counsel, and may examine any witnessed who testify and have the entire evidence recorded at your expense; however, such shall not be mandatory.
