NOTICE OF TRUSTEE SALE Pursuant to the authority vested in the undersigned by a deed of trust dated May 16, 2005, and recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Trust Deed Book 613, at page 619, signed by Greeley S. Martin and Linda Martin, to Scott D. Maddox, Attorney at Law, and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by Inez Deposit Bank, to foreclose thereunder, the undersigned will offer for sale at public auction at the front door of the Wayne County Courthouse n Wayne, West Virginia, on: MAY 31, 2016 at 2:00 p.m. the following described real estate, with improvements thereon, easements and appurtenances thereunto belonging, situate on Mud Lick Fork of Jennie's Creek, Lincoln District, Wayne County, West Virginia, and bounded and described as follow, to-wit: Beginning at a stake 40 feet up the hollow from the Lyle and Eunice Dillon Corner; thence going up the hollow following the creek bed approximately 300 feet to a stake next to a large rock; thence going up the hill in a westerly direction to a large standing rock; thence around the hill approximately 400 feet to a large rock on a point; thence downhill to the first corner stake; the point of beginning, containing approximately Five (5) acres, more or less. Also granting and conveying unto the party of the second part, or the survivor, a 15 foot right of way extending to the family cemetery and to the subject property as the same now exists. And being the same property conveyed to Greeley Stewart Martin, by deed from Raymond Maynard and Martha Maynard, his wife, by deed dated the 17th day of August, 2004, and of record in the aforesaid clerk's office in Deed Book 638, at page 72. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. TERMS OF SALE: Cash in hand on day of sale or within 14 days of sale upon terms to be agreed upon between Trustee and successful bidder; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is. Any purchaser at sale is further advised that the transaction is not complete until the Trustee Deed is delivered and recorded.
