TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 15, 2007, and duly recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Document No. 312977 963, in Book No. 655, at Page 198, Gary A Hammons, Jr did convey unto Philip Hereford, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated March 3, 2012 and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by JPMorgan Chase Bank, National Association to foreclose thereunder, will offer for sale at public auction at the front door of the Wayne County Courthouse in Wayne, West Virginia, on August 16, 2016 at 2:45 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Wayne Ind. District, Wayne County, West Virginia, and more particularly described as follows: Parcel One: The Westerly one-half of all that certain lot, piece or parcel of ground, situate in the Town of Wayne, Wayne County, West Virginia, and fronting on Keyser Street, in said Town of Wayne, and described as follows: BEGINNING at a stake in the Southerly margin of Keyser Street in the said Town of Wayne, and being the North West corner to the Lot formerly owned by Elizabeth K. Ferguson; thence with a Southerly direction with the line of the said Elizabeth K. F. And A. M. And Wayne Chapter number 18, R. A. M. to R. A. Ramey and formerly owned by P.P. Lester, 106 feet 6 inches, to a stake in the northerly margin of a 12-foot alley; thence with the said northerly margin of alley in a westerly direction 46 feet to a stake in the margin of an alley; thence in a northerly direction with the easterly margin of said alley 106 feet 6 inches said to a stake in the southerly margin said Keyser Street; thence an easterly direction with the said southerly margin of said Keyser Street 46 feet to the BEGINNING. Parcel Three: All that certain tract or parcel of real estate situate on Hall Street, in the Town of Wayne, Wayne Independent District, Wayne County, West Virginia, bounded and described according to an actual survey of the same, made by Randall E. Thompson, Surveyor, on the 12th day of May, 1990, as follows: BEGINNING at an iron pin and cap (set) in the south line of a 12-foot alley, and at the northeast corner of Lillian Sansom (DB 4 70 PG 485); thence, leaving Sansom and with said alley, North 85 45' East 45 feet to an iron pin and cap (set) at the southeast end of said alley, and in the west line of Dixie Booten; thence, leaving the alley and with the Booten, S. 3 43' East 15.00 feet to a concrete monument (found) at the northwest corner of Vesta Blankenship (DB 407 PG 147); thence, leaving Blankenship and Booten, and running through the land of Nettie Workman S. 85 45' West 46.00 feet to an iron pin and cap (set) in the east line of Lillian Sansom; thence, with said line, North 3 43' West 15.00 feet to the point of BEGINNING, containing SIX HUNDRED NINETY (690) SQUARE FEET or SIXTEEN ONE-THOUSANDTHS (0.016) ACRE. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 315 Keyser St, Wayne, WV 25570. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $6,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.
