NOTICE IN THE CIRCUIT COURT OF CABELL COUNTY, WEST VIRGINIA UPON PROCEEDINGS TO CONDEMN LAND FOR PUBLIC USE. PROJECT NO. E306-43-413.15 FEMA-4221(000) PARCEL NO. 1 CIVIL ACTION NO. 16-C-482 JUDGE: Christopher D. Chiles WEST VIRGINIA DEPARTMENT OF TRANSPORTATION, DIVISION OF HIGHWAYS, a State Agency, Petitioner, vs. DEXTER DALE RAMEY; DEXTER DALE RAMEY JR.; RHONDA Z. FULDAUER; ANY UNKNOWN HEIRS OF CLARENCE H. RAMEY; APPALACHIAN POWER COMPANY and T.W. MCCOMAS Sheriff of Cabell County Defendants. ORDER OF PUBLICATION The object of the above entitled action is to condemn certain real estate for public purposes under the provisions of Code 54-2-14a of the Official Code of the State of West Virginia of 1931, as amended from those among those entitled thereto. The lands over, through and from which said rights of way and easements for said public purposes are proposed to be taken in the proceeding and the specific rights of way and easements therein, which are herein sought, are: All that certain property is situate in McComas District, Cabell County, West Virginia, and is more particularly bounded and described as follows, to-wit: NONCONTROLLED ACCESS RIGHT OF WAY BEGINNING at point in the western proposed noncontrolled access right of way line of Cabell County Route 43, said point being in the western existing right of way line and 15 feet right of and at right angle to Cabell County Route 43 centerline at Station 5+15, Project E306-43-413. 15, FEMA-4221(000), Cabell County, West Virginia; thence, southeasterly, with the meanders of said existing right of way line 106 feet, more or less, to a point in the western proposed noncontrolled access right of way line of Cabell County Route 43, said point being 15 feet right of and at right angle to centerline at Station 6+20; thence, southwesterly, with said proposed right of way line, 37 feet, more or less, to a point 52 feet right of and at right angle to centerline at Station 6+20; thence, northerly, continuing with said proposed right of way line 105 feet, more or less, to a point 49 feet right of and at right angle to centerline at Station 5+15; thence, northeasterly, continuing with said proposed right of way line 34 feet, more or less, to the point of beginning and containing 3,714 square feet, more or less. The tract of land hereinabove described is a portion of that same real estate conveyed unto the late Roy Lee Ramey and Genoa Ramey, jointly with right of survivorship, by deed dated January 29, 1945 of record in the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 344 and Page 351. By deed dated January 20, 1954, of record in the office of the aforesaid clerk at Deed Book 484 at Page 58, the said Roy Lee Ramey conveyed all of his right title and interest into the aforesaid property to the said Genoa Ramey. The said Genoa Ramey died on or about March 6, 1992, and, by the terms of her Will of record in the aforesaid clerk's office in Will Book 117 at Page 363, devised the aforesaid property to her children Dexter D. Ramey, John D. Ramey, Douglas G. Ramey, Zelma Ramey Hazelett, Clarence H. Ramey, Thelma Bernice Ramey Berry, Darrell G. Ramey and Dwight L. Ramey, each with an undivided 1/8 interest. The said Darrell G. Ramey conveyed his undivided 1/8 interest to Dexter D. Ramey, by deed dated May 26, 1992, of record in the aforesaid clerk's office in Deed Book 970 at Page 690. By Deed dated June 1, 1998, of record in the aforesaid clerk's office in Deed Book 1033 at Page 416, John D. Ramey and Helen K. Ramey (his wife), Dwight Lee Ramey and Phyllis J Ramey (his wife) Douglas G. Ramey and Helen Ramey (his wife) and Zelma Ramey Hazelett and Winfield Hazelett (her husband) conveyed their respective undivided 1/8 interests unto the said Dexter Dale Ramey and Dexter Dale Ramey Jr. jointly with right of survivorship. Thereafter, by deed dated March 16, 2004, of record in the aforesaid clerk's office in Deed Book 1120, at Page 428, the said Thelma Bernice Ramey Berry (widow) conveyed her undivided 1/8 interest unto Dexter Dale Ramey and Dexter Dale Ramey Jr. as joint tenants with right of survivorship. Upon information and belief of the Petitioner, the said Clarence H. Ramey died in Cuyahoga County, Ohio on or about November 16, 2011, without having conveyed his undivided 1/8 interest in the subject property. It appearing by affidavit filed in this action that there may be unknown heirs of the said Clarence H. Ramey, whose names are unknown to the Petitioner and who are made Defendants by the general description of unknown heirs of Clarence H. Ramey. It is therefore Ordered that the above described person(s) do appear and serve upon Charles Houdyschell Jr., Petitioner's Attorney, whose address is P.O. Box 880, Huntington, WV 25712, an answer or other defense to the Application filed in this action on or before September, 5, 2016, otherwise judgment by default will be taken against them at any time thereafter.
