NOTICE OF SUCCESSOR TRUSTEE'S SALE Notice is hereby given that by virtue of the following deed of trust: Commercial Deed of Trust, Security Agreement, Fixture Filing Financing Statement and Assignment of Leases, Rents, Income and Profits dated November 30, 2005, made by GL Equities, LLC, a Florida limited liability company, to Aaron C. Ambler, Trustee, for the benefit of Artesia Mortgage Capital Corporation, a Delaware corporation, which deed of trust is of record in the Office of the Clerk of the County Commission of Putnam County, West Virginia, in Trust Deed Book No. 773, at Page 334. The deed of trust was assigned by Artesia Mortgage Capital Corporation to Wells Fargo Bank, N.A., as trustee for the registered holders of Wachovia Bank Commercial Mortgage Trust, Commercial Mortgage Pass-Through Certificates, Series 2006-C23, by assignment of record in the aforesaid Clerk's Office in Assignment Book No. 44, at Page 11. The deed of trust was assigned by Wells Fargo Bank, N.A. as trustee for the registered holders of Wachovia Bank Commercial Mortgage Trust, Commercial Mortgage Pass-Through Certificates, Series 2006-C23, to Bank of America, N.A., as trustee for the registered holders of Wachovia Bank Commercial Mortgage Trust, Commercial Mortgage Pass-Through Certificates, Series 2006-C23, by assignment of record in the aforesaid Clerk's Office in Assignment Book No. 48, at Page 685. The deed of trust was assigned by Bank of America, N.A. as trustee for the registered holders of Wachovia Bank Commercial Mortgage Trust, Commercial Mortgage Pass-Through Certificates, Series 2006-C23, to U.S. Bank National Association, as trustee, successor-in-interest to Bank of America, N.A., as trustee, successor to Wells Fargo Bank, N.A., as trustee, for the registered holders of Wachovia Bank Commercial Mortgage Trust, Commercial Mortgage Pass-Through Certificates, Series 2006-C23, by assignment of record in the aforesaid Clerk's Office in Assignment Book No. 58, at Page 443. Christopher J. Plybon having been named Successor Trustee by Notice of Substitution of Trustee recorded in the aforesaid Clerk's Office in Trust Deed Book 1129, at Page 723. Default having been made in the payment of the obligations secured by such deeds of trust, the undersigned, Christopher J. Plybon, Successor Trustee, having been required to do so by U.S. Bank National Association, the successor beneficiary of said deed of trust and the successor trustee for the registered holders of the obligations secured by such deed of trust, and having full and absolute power and authority in the premises, will on the 7th day of July, 2016, at 9:00 a.m. Eastern Time, offer for sale and sell at public auction, for cash to the highest bidder, at the main front door of the County Courthouse of Putnam County, on Winfield Road, Winfield, West Virginia, the following described property: The Property is located in Putnam County, West Virginia, and is legally described as follows: A tract or parcel of land situated on Hospital Drive, Putnam County, West Virginia, and being more particularly described as follows: Beginning at a 5/8 Inch re-bar, found, at the intersection of Hospital Drive and Granada Circle; thence with the southern right of way for said Granada Circle South 81-50 East a distance of 129.93 feet to a 5/8 inch re-bar, found, in the southern line of said Granada Circle, corner to Lot 1 of Granada Estate; thence with the line of Lot One South 8-10 west a distance of 356.93 to a 5/8 inch re-bar, found, on the line of Jonseric, corner to RBM Development, thence with said RBM Development South 88-01 west, a distance of 132.00 feet to a maig nail set in a drill hole, on the eastern right of way line for Hospital Drive; thence with said Hospital Drive North 08-10 East a distance of 379.19 feet to the place of beginning and containing 1.10 acres of land more or less, as surveyed by Timothy H. Kinder, P. S., of American Land Surveying of Scott Depot, West Virginia. And being Parcel Three of the land conveyed unto GL Equities, LLC from First Chesapeake Corporation as recorded in Deed Book 444 at page 812 and recorded In the Office of the Clerk of the County Commission of Putnam County, West Virginia. Property address: 1201 Hospital Drive, Hurricane, West Virginia 25526 TERMS OF SALE: 1. Cash in hand paid on the day of sale. 2. The sale is made "where is, as is" with no warranty whatsoever. The Successor Trustee shall have no responsibility for removal of any tenant or other party in possession of said property. 3. Subject to any and all assessments and taxes against said property, and all matters of record in the aforesaid Clerk's Office senior in priority to the deeds of trust under which this sale is being made, including without limitation all prior liens and encumbrances of any nature whatsoever., including, without limitation, the liens for ad valorem real estate taxes for the year 2016 and following. 4. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 22 of Chapter 11 of the West Virginia Code. 5. If the sale is set aside, the purchaser at such sale may be entitled to only a return of the amount paid less any applicable fees and costs and shall have no further recourse against the Successor Trustee, the Beneficiary, or any other person or entity. 6. The Successor Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof.
