TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 15, 2000, and duly recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Document No. 96045, in Book No. 515, at Page 514 and reformed Document in Book No. 772, at Page 994, Opal Thacker did convey unto Nations Title Agency of Ohio, Inc., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated May 9, 2016 and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by CHRISTIANA TRUST, A DIVISION OF WILMINGTON SAVINGS FUND SOCIETY, FSB, AS TRUSTEE FOR NORMANDY MORTGAGE LOAN TRUST, SERIES 2013-16 to foreclose thereunder, will offer for sale at public auction at the front door of the Wayne County Courthouse in Wayne, West Virginia, on June 28, 2016 at 2:45 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in So. Westmoreland District, Wayne County, West Virginia, and more particularly described as follows: All that certain tract, piece or parcel of real estate, situate on the waters of Bob's Branch, Westmoreland District, Wayne County, West Virginia, being more particularly bounded and described as follows, to-wit: Beginning at a corner at Bob's Branch and the comer of Reuben Allman and Evelyn Hatfield Line and running southwardly 145 feet along the Cauliflower Line to an established iron stake as a corner; thence running eastwardly 425 feet to another stake as a corner; thence 114 feet northwardly to the farm road; thence along this farm road westwardly 221 feet to Bob's Branch; thence along Bob's Branch 425 feet westwardly to the beginning, containing five (5) acres, more or less. Excepting, however, that certain parcel of land 100 X 120 feet in size, heretofore conveyed to Richard Ward and Bonnie Ward, his wife, by deed dated April 10, 1963, and recorded in the office of the Clerk of the County Court of Wayne County, West Virginia, in Deed Book no. 334, at Pg. 455. Less and excepting the following two tracts: 1. All that certain tract, piece or parcel of real estate, situate on the waters of Bob's Branch, Westmoreland District, Wayne County, West Virginia, being more particularly bounded and described as follows, to-wit: Beginning at a corner at Bob's Branch and the corner of Reuben Allmond and Evelyn Hatfield Cochran and running in a southerly direction a distance of 95 feet along and with the Cauliflower Line to an established Iron Stake as a corner; thence running in an easterly direction, more or less parallel to Bob's Branch; a distance of 186 feet to a stake at a corner; thence running in a northerly direction, more or less parallel to the Cauliflower Line, a distance of 90 feet to Bob's Branch; thence along Bob's Branch in a westerly direction 230 feet, more or less, to the point of beginning, containing one acre more or less. Together with a 15-foot right-of-way running from the third corner as set forth in the above description in an easterly direction to the corner of the property owned by Jimmy 0. Thacker and Thelma Thacker, which right-of-way is for the purpose of ingress and egress to the property above described and for other purposes necessary and incidental to the use and occupancy of the parcel herein described. 2. Beginning at a point in the western proposed noncontrolled access right of way line, said point being in the division line between Evelyn Rowe, and James 0. and Myrtie Thacker, and 15 feet right of and at right angle to Project Baseline Station P.C. 4+01.4, Project: Bob's Branch Road, Wayne County, West Virginia; thence, southeasterly with said division line, by a radial line 15 feet, to a point common to Evelyn Rowe, Evelyn Mayo Hatfield, and James 0. and Myrtie Thacker, said point being on Baseline, at Station P.C. 4+01.4; thence, southeasterly with said division line, with a curve to the left having a radius of 88.14 feet, and arc distance of 58.72 feet, to a point on Baseline, at Station P.T. 4+60.12; thence, S. 01 degree 30 seconds E., with said division line 0.33 feet, to a point on Baseline, at Station P.C. 4+60.45; thence southeasterly, continuing with said division line, with a curve to the left having a radius of 66.62 feet, and arc distance of 15.55 feet, to a point common to Evelyn Mayo Hatfield, Jimmy 0. and Thelma Jean Thacker, and James 0. and Myrtie Thacker, said point being on Baseline, at Station 4+76; thence, southwesterly with the division line between Jimmy 0. and Thelma Jean Thacker, and James 0. and Myrtie Thacker, by a radial line, 15 feet to a point in the western proposed noncontrolled access right of way line, said point being 15 feet radially right of Baseline Station 4+76; thence, northwesterly with said proposed noncontrolled access right of way line, in a reverse baseline direction, with a curve to the right having a radius of 81.62 feet, concentric to baseline 19.05 feet, to a point 15 feet right of and at right angle to Baseline Station P .C. 4+60.45; thence, N. 01 degrees 30 seconds W., with said proposed noncontrolled access right of way line, parallel to baseline 0.33 feet, to a point 15 feet right of and at right angle to Baseline Station P.T. 4+60.12; thence, northeasterly, continuing with said proposed noncontrolled access right of way line, with a curve to the right having a radius of 103.14 feet concentric to baseline 68.71 feet, to the place of beginning and containing 0.03 acres, more or less, and being a part of that same parcel of land conveyed onto James Orville Thacker and Myrtie D. Thacker, by Deed from Larry Gene McGlothen and Juanita McGlothen, husband and wife, dated December 8, 1966 of record in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Deed Book 363, at Page 386. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 255 Sherwood Drive, Huntington, WV 25704 aka 255 Right Fork Sherwood Drive Huntington, WV 25704. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $3,500.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
