NOTICE OF TRUSTEE'S SALE Notice is hereby given that by virtue of authority vested in the undersigned Trustee by that certain Deed of Trust executed by Terry A. Henry and Alice M. Henry to Ronald J. Flora, as Trustee, for the benefit of Richard P. Edmonds Nancy L. Edmonds, his wife, or the survivor, dated the 19th day of July, 2013 and ofrecord in the Office of the Clerk of the County Commission of Cabell County, West Virginia, inTrust Deed Book 2495, at Page 603, to secure the payment of certain note set out and described therein, and default having been made in the payment of said note, and the said Ronald J. Flora, having been requested so to do by the owners and holders of said note, shall sell to the highest and best bidder, on Friday the 24th day of February, 2017 at 9:00 a.m., at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, the real estate, conveyed by said Deed of Trust together with the improvements thereon and the appurtenances thereunto belonging, and being more particularly described therein as follows: All that certain tract or parcel ofland situate on the east side of East Mud River Road (Local Service Road 25), in Grant District, Cabell County, West Virginia, and being more particularly bounded and described as follows: Beginning at a 1-1/2" diameter galv. pipe (set) on the easterly right-of-way line of Mud River Road (W.Va. County Rte 25), a comer to a 1.05 acre tract ofland; thence, South 29 32' East, 300.39 feet to a 1-1/2" diameter galv. pipe (set), North 74 46' East, 196.02 feet to a 1-1/2" diameter galv. pipe (set) on the southwesterly line of the land now or formerly owned by Richard and Nancy L. Edmonds; thence, leaving the land of said 1.05 acre tract, with the land of said Richard and Nancy L. Edmonds, South 43 58' East, 349.72 feet to a 28" Chestnut Oak (found) on the westerly line of the land now or formerly owned by Susan B. and Geoffrey A. Hadad; thence, leaving the land of said Richard and Nancy L. Edmonds, with the lands of said Susan B. and Geoffrey A. Hadad, South 18 49' West, passing a 1-1/2" diameter galv. pipe (set)at 353.78 feet, then passing a 1-1/2" galv. pipe (set) at 1242.90 feet, a total distance of 1743.07 feet to a stone monument (found) with and "X" cut in the top found on the hillside above Charley Creek and on the northerly line of the land now or formerly owned by Lester and Maxine M. Conner; thence, leaving the land of said Susan B. and Geoffrey A. Hadad, with the land of said Lester and Maxine M. Conner, then the land now or formerly owned by James F. Scheidler, and then the land nor or formerly owned by Lester F. and Maxine L. Conner, South 81 50' West, 559.90 feet to a 1-1/2" diameter galv. pipe (set) on the southeasterly line of the land now or formerly owned by Edgar and Margaret Conner; thence, leaving the land of said Lester F. and Maxine L. Conner, with the land of said Edgar and Margaret Conner, as follows; North 48 00' East, 29.54 feet to a 1-1/2" diameter galv. pipe (set), North 72 20' West 118.80 feet a 1-1/2" diameter galv. pipe (set), North 80 55' West 101.96 feet to a 1-1/2" diameter galv. pipe (set) on the easterly right-of-way line of said Mud River Road; thence, leaving the land of said Edgar and Margaret Conner, with the easterly right-of-way line of said road, as follows: with a curve to the right having a radius of 479.10 feet, an arc distance of 78.11 feet, the chord of which bears North 04 04' West for a distance of 78.02 feet; thence leaving said curve, North 00 37' East 180.65 feet; thence, with a curve to the right having a radius of 991.30 feet, an arc distance of 387.44 feet, the chord of which bears North 11 48' East for a distance of 384.98 feet; thence leaving said curve, North 23 00' East 246.61 feet; thence, with a curve to the left having a radius of 556.63 feet, an arc distance of 298.79 feet, the chord of which bears North 07 37' East for a distance of 295.22 feet; thence leaving said curve, North 07 45' West, 167.82 feet; thence, with a curve to the right having a radius of 621.39 feet, an arc distance of 228.56 feet, the chord of which bears North 02 47' East for a distance of 227.27 feet; thence leaving said curve, North 13 19' East 179.88 feet; thence, with a curve to the right having a radius of 348.12 feet, an arc distance of 293.44 feet, the chord of which bears North 37 28' East for a distance of 284.83 feet; thence leaving said curve, North 61 37' East 357.33 feet to the point of beginning, containing 41.45 Acres, more or less, and as shown on the plat of survey prepared by Gary M. Walker & Assoc., Inc., Licensed Land Surveyor, dated January 15, 1996, revised March 15, 1997, a copy of which is recorded in the Office of the Clerk of the County commission of Cabell County, West Virginia in Deed Book 1016, Pages 698, 699, 700 and 701, AND EXCEPTING from the above described parcel the following 0.689-acre parcel and being more particularly described as follows; Beginning at a 1-1/2-inch galvanized pipe (found) in the westerly line of the lands of Richard and Nancy L. Edmonds (Db 739, Pg. 648) and said pipe also being at the southeasterly comer of a 1.05 acre parcel, currently in the name of Richard P. and Nancy L. Edmonds (Db 1127, Pg. 62), thence leaving said 1.05 acre parcel and with the southerly line of said Edmonds (Db 739, Pg. 648), S 43 48'50" E, 348.87 feet to a 36-inch Chestnut Oak (formerly described as a 28-inch Chestnut Oak) in the (mostly fallen) fence line, and in the westerly line of the lands of Susan B. & Geoffrey A. Haddad (Db 825, Pg. 672), thence leaving said Haddad and severing the lands of Richard P. and Nancy L. Edmonds (Db 1127, Pg. 62), N 65 03'50" W, 474.94 feet to a 1-1/2-inch pipe (found) at the southwest comer of the aforesaid 1.05 acre parcel, thence with the southerly line of said 1.05 acre parcel, N 74 46' E, 196.02 feet to the place of beginning, and containing an area of 0.689 acre, more or less; leaving a total area conveyed herein of 40.761 acres, AND RESERVING a 20-foot wide right of way leading to and from said East Mud River Road for access, ingress and egress for the Grantors and their heirs and assigns, along the westerly line of the aforesaid 1.05 acre parcel, said right-of-way shall be 20- feet wide and runs parallel to the westerly side of the 1.05 acre parcel. This property is conveyed subject to the following restrictions which are binding and are an covenant running with the land. 1. All motor vehicles requiring licenses must be licensed while situate on the property conveyed hereby. 2. Any mobile home (if applicable and if the same meets with appropriate zoning standards and zoning regulations) must be underpinned within thirty (30) days of their placement upon the property conveyed hereby. And being a part of the same parcel conveyed to Richard P. and Nancy L. Edmonds, husband and wife by David F. and Winalee M. Blackwood, husband and wife by deed dated July 14, 2004 and of Record in Deed Book 1127, at Page 59 in the Office of the Clerk of the County Commission of Cabell County This sale is made subject to any special assessments, liens of record, unpaid real estate taxes, unpaid municipal fees, easements, conditions, reservations and restrictions affecting the aforesaid real estate. This property is subject to any pre-existing Federal Tax Liens and/or State Tax Liens and any rights which may accrue to the State of West Virginia or the United States of America regarding the same. Trustee shall be under no duty to cause any person who may be occupying the property to vacate. This property shall be sold in an "as is" condition. Any Deed delivered by Trustee to the Purchaser shall be without any covenant or warranty. The Trustee hereby makes no representation as to the warranty, of any kind or character, regarding the title to the property. Any purchaser at the above sale shall be responsible for the payment of all transfer taxes, real estate taxes and recording fees regarding any Deed which may issue from the sale.
