TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Trustee, by virtue of the authority vested by that certain Deed of Trust, dated August 24, 2007, and duly recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Document No. 312981207, in Book No. 659, at Page 499 and reordered in Document No. 3130474583, in Book No. 68, at Page 366, Daniel L. Ward and Jennifer Ward did encumber certain real property described in said Deed of Trust; and Seneca Trustees, Inc., as having been appointed as Trustee by Court Order and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust to foreclose thereunder, will offer for sale at public auction at the front door of the Wayne County Courthouse in Wayne, West Virginia, on January 10, 2017 at 2:45 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Huntington (Westmoreland) District, Wayne County, West Virginia, and more particularly described as follows: THE FOLLOWING DESCRIBED REAL ESTATE LYING AND BEING IN WAYNE COUNTY, WEST VIRGINIA, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS, TO-WIT: ALL THAT CERTAIN LOT, PIECE OR PARCEL OF LAND SITUATE IN THE CITY OF HUNTINGTON, WAYNE COUNTY, WEST VIRGINIA, KNOWN AND DESIGNATED ON A MAP OF CLYDE FIELD'S SUBDIVISION OF LOTS 11 AND 12 BLOCK 19, DUPONT PLACE, A COPY OF WHICH MAP WAS RECORDED IN THE OFFICE OF THE CLERK OF THE COUNTY COURT OF WAYNE COUNTY, WEST VIRGINIA, MAY 7, 1925, IN DEED BOOK NO. 140, PAGE 95, AS LOTS NUMBERS THREE (3) AND FOUR (4), AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT A POINT IN THE NORTH LINE OF AUBURN ROAD AT THE SOUTHWEST CORNER OF LOT 4 OF SAID SUBDIVISION, SAID POINT BEING THE ORIGINAL CORNER BETWEEN LOTS 12 AND 13 OF SAID BLOCK 19, DUPONT PLACE; THENCE WITH SAID LINE OF AUBURN ROAD, N. 83 DEGREES 04 MINUTES E. 70 FEET; THENCE WITH THE LINE BETWEEN LOTS 2 AND 3, OF SAID SUBDIVISION N. 11 DEGREES 30 MINUTES W. 113.12 FEET; THENCE WITH THE SOUTH LINE OF LOT 5 OF SAID SUBDIVISION, S. 80 DEGREES 30 MINUTES W., 70 FEET TO A POINT IN THE ORIGINAL LINE BETWEEN LOTS 12 AND 13; THENCE WITH SAID LINE S. 11 DEGREES 30 MINUTES E. 110 FEET TO THE POINT OF BEGINNING; TOGETHER WITH THE RIGHT AND USE OF A STRIP OF LAND ON THE REAR OF LOTS NO. 1 AND 2 OF SAID SUBDIVISION FOR SEWER PURPOSES AS SET OUT IN DEED FROM LUTHER FRALEY, ET AL, TO CHARLES R. LONG AND BEATRICE V. LONG, DATED JULY 27, 1944, AND RECORDED IN THE AFORESAID COUNTY CLERK'S OFFICE IN DEED BOOK 218, PAGE 419. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 4208 Auburn Rd, Huntington, WV 25704. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
