NOTICE NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 20th day of July, 2010, Milton Grass and Laura Grass, Grantors, to Phillip A. Vallandingham and Samuel A. Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2340, beginning at page 556, and the undersigned, Daniel T Yon and Melissa Eakle Leasure, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Bonds, Contracts and Leases Book 386 at page 369, having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on June 24, 2016 at 11:00 a.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real more particularly described as follows: All that certain lot, piece or parcel of land situate on Barker Ridge and on the waters of Big Cabell Creek, Union District, Cabell County, West Virginia, more particularly bounded and described as follows: BEGINNING at a 2 inch angle iron (found), corner to Walter L. and Caroline R. Spence (DB 720, Pg 383), and Donna L. Burgess (Spurlock) (DB 1031, PG 708), said 2 inch angle iron also located on the west limits of a 20 foot common access easement through the Spence property; thence, with the common division line between Spence and Burgess N. 37 15' 36" W. 433.28 feet to a 2 inch (od) by a 30 inch pipe (set) of the east side of a deep ravine; thence, leaving the common line of Spence and Burgess and severing through the lands of Walter L. and Caroline R. Spence (DB 720, PG 383), up the ravine N. 14 36' 53" E. 68.06 feet to a 2 inch (od) by a 30 inch pipe (set) in the deep ravine; thence, leaving the ravine S. 56 20' 59" E. 290.22 feet to a 2 inch (od) by 30 inch pipe (set) on the west limits of the aforementioned 20 foot common access easement through the Spence property; thence with the west limits of the 20 foot common access easement S. 0 34' 49" W. 136.24 feet to a 2 inch (od) by a 30 inch pipe (set); thence continuing with the 20 foot common access easement S 2 29' 32" E. 113.76 feet to the place of BEGINNING, containing 41,081 square feet or 0.94 acres more or less, and as shown on a plat dated December 22, 2001, and titled "Plat of Survey for Frances E. Clark showing a 0.94 acre Lot" as surveyed by Duane K. Bowers PS 1995. Survey is made subject to any and all right of ways, easements and reservations which may be a matter of record. Also, access to this lot is over and through the 20 foot common easement, with the right of ingress and egress, subject to an agreement of mutual maintenance and upkeep to be shared equally with adjoiners. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale.
