COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS November 30, 2016 City of Huntington 800 5th Avenue Huntington, WV 25701 304-696-4486 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Huntington. REQUEST FOR RELEASE OF FUNDS On or about December 16, 2016 the City of Huntington will submit a request to the U.S. Department of Housing and Urban Development for the release of Federal funds under Title I of the Housing and Community Development Act of 1976 (PL 93-383), as amended, to be used for the following to be used for the following project: CDBG '16 - Demolition 2016. This activity consists of testing, abatement, demolition, and disposal of unsafe and dilapidated structures on a citywide basis. Each structure will be submitted to the State Historic Preservation Office (SHPO) individually for Section 106 consultation. Estimated projects costs: $200,000. Project Aggregation: This project is a multi-year project. The ERR covers the estimated range of aggregated activities the demolition of vacant buildings and structures to remove slum and blight. Total estimated project cost is $400,000. Tiering: The specific locations are yet to be determined. The SHPO will be consulted when site -specific reviews are conducted. With the possible exception of historic properties and environmental site hazards, ie asbestos containing materials, there are no known circumstances requiring compliance with regulatory or statutory regulations. In the event that unanticipated impacts, or impacts not immediately addressed within the ERR are found, a Request for Release of Funds will be made for the site-specific impacts. FINDING OF NO SIGNIFICANT IMPACT The City of Huntington has determined that the project(s) will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Office of Development & Planning, 800 5th Avenue, Room L7, Huntington, WV and may be examined or copied weekdays (8:30)A.M to (4:00) P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR(s) to the Office of Development & Planning, 800 5th Avenue, Room L7, Huntington, WV. All comments received by December 15, 2016 will be considered by the City of Huntington prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. RELEASE OF FUNDS The City of Huntington certifies to the U.S. Department of Housing & Urban Development that Steve Williams in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The U.S. Department of Housing & Urban Development's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Huntington to use Program funds. OBJECTIONS TO RELEASE OF FUNDS The U.S. Department of Housing & Urban Development will consider objections to its release of funds and the City of Huntington's certification received by December 31,2016 or a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Huntington or other officer of the City of Huntington approved by the U.S. Department of Housing & Urban Development; (b) the City of Huntington has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the U.S. Department of Housing & Urban Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at the Pittsburgh Area Office, William Moorhead Federal Building, 1000 Liberty Avenue, Ste. 1000, Pittsburgh, PA 15222-2515.
