Wells and James O. Wells did convey unto Dru A. Shope, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 24, 2016 and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MidFirst Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Wayne County Courthouse in Wayne, West Virginia, on December 20, 2016 at 2:45 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Ceredo District, Wayne County, West Virginia, and more particularly described as follows: A parcel of land situated on the waters of Dock Creek of the Big Sandy River, Ceredo District, Wayne County, West Virginia more particularly described as follows: Beginning at a rebar and cap, found, at the northeastern corner of a parcel of real estate conveyed by Edward L. and Judy E. Ritchie to Margaret Wagner as recorded at the Office of the Clerk of Wayne County in Deed Book 625 at page 110. Said point is also situated on the southern right of way limits of WV Secondary Route 8/1 known as Hutchinson Branch Road. Thence, continuing with said right of way and said Wagner S 43 51' 40" E 88.85 feet to a rebar and cap, found. Said point being the True Point of Beginning for the parcel here-in described. In addition, this said point is the northeastern corner to the residue of a 3.1 acre parcel of real estate conveyed by Clarence N. Sr., and Eloise W. Arthur to Gerald and Eulah Williamson as recorded at said clerk's office in Deed Book 262 at page 369. Thence, leaving said right of way and continuing with said Wagner S 07 11' 05" W 226.09 feet to a rebar and cap, found. Said point being the northeastern corner to a parcel of real estate conveyed by Dr. Richard T. Hoback to David R. and Lisa D. Keefer as recorded at aforesaid clerk's office in Deed Book 604 at page 577. Thence, leaving said Wagner and continuing with said Keefer S 55 03' 55" E 72.03 feet to a rebar and cap, set. Thence, leaving said Keefer and continuing with a new division line through aforesaid residue N 44 55' 00" E 173.42 feet to a rebar and cap, set, in the southern right of way limits of WV Secondary Route 8/3. Thence, leaving said division line and continuing with said right of way N 58 28' 05" W 50.18 feet to a point. Thence, continuing N 43 28'05" W 160.54 feet to the place of beginning. This parcel contains 0.56 acres, more or less, and designated as Parcel No. 1 on a plat titled "Plat Of Survey Showing The Division Of The Residue Of The Gerald & Eulah Williamson Estate", prepared by Empire Consulting Services, L.L.C. on December 5th, 2005 and is being referred to and being made a part of this description. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
