NOTICE NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 2nd day of November, 2015, Laura Grass and Milton Grass, Grantors, to Samuel A. Vallandingham, and Philip Andrew Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2598, beginning at page 162, and the undersigned, Daniel T Yon and Melissa Eakle Leasure, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Bonds, Contracts and Leases Book 386 at page 368, having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on June 24, 2016 at 11:00 a.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real more particularly described as follows: All that certain piece, parcel or tract of real estate situate in Union District, Cabell County, West Virginia, and being more particularly described as follows: PARCEL NO. 1: BEGINNING at a stake on a hillside in the West line of Jas. H. Woods tract (Now Jno. Will Dailey); thence N. 3 E. 991 feet to a stake on the south side of the branch in A. Bicker's line; thence with the same N. 72 W. 673 feet to a stake on the ridge-corner to Jackson Smith's land; thence with the same N. 37 W. 354 feet to a stake; thence S. 3 1427 feet to a stake in the north line of John G. Woods tract; thence with the same S. 87 E. 897 feet to the place of BEGINNING, containing 25 acres, more or less. PARCEL NO. 2: BEGINNING at the joining corners between S. E. White and Pearl Dailey, in the line of Margaret Dailey's land; thence S. 30 poles to the corner of Margaret Dailey's land; thence about E. 50 Poles to a stone; N. 33 poles to a stone in Will Wood's line; thence about E. 74 poles and 35 feet to the BEGINNING, containing 17-1/4 acres, more or less. EXCEPTING a five (5) acre tract from the above described parcels as conveyed by Deed Dated August 2, 1964, by Verna Dailey Edmond and Clayton Edmond, husband and wife, to Victor Dailey and Ruth Dailey, husband and wife, as recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 622, at Page 684. There is also hereby conveyed that certain twenty foot right of way more particularly described in that certain deed dated June 17, 1981, and of record in the aforesaid Clerk's Office in Deed Book 824, at Page 110. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended. Any sale may be conducted or adjourned by the designated agents or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as substituted Trustee.
