NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated July 29, 2005, executed by Borrower, Elena M Ermolaeva, to Dru A. Shope, the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2026, at Page 496. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 155 Kings Highway, Huntington, WV 25705. Pill & Pill, PLLC was appointed as Substitute Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 29, 2016, of record in the Clerk's Office in Book 385, at Page 626. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: May 31, 2016 at 2:22 p.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Huntington Guyandotte District, Cabell County, West Virginia, and being more particularly described as follows: PARCEL ONE (1) : All that certain lot, piece, or parcel of land situate in the City of Huntington, Cabell County, West Virginia, known and designated on that certain revised map of Roland Park, made by Edward B. Raiguel, Consulting Engineer, which map was filed in the Office of the Clerk of the County Commission of Cabell County, West Virginia, on the 20'h day of October, 1925, and recorded in Map Book 3, at Page 32, as LOT NO. 91 and PART OF LOT 90, bounded and described as follows: BEGINNING at a stake (set) in the Westerly line of a circle at the Westerly end of Kings Highway, said beginning point being a corner common to Lots No. 91 and 92, thence from the said beginning and with the dividing line between said Lots, South 73 24' West 102.82 feet to a stake, a corner common to Lots No. 91, 92, 109, and 110, thence with the back line of Lots No. 110, 110-A and Part of Lot 110-B, North 26 17' E. 144 feet to a stake, a corner common to Lots No. 90 and 91, and in the Easterly line of Lots No. 110-B, thence crossing through Lot No. 90, South 47 07' East 97.36 feet to a stake in the Westerly line of said circle at the Westerly end of Kings Highway, thence with the said line, curving to the left on the arc of a circle, with a radius of 35 feet, passing the corner common to Lots 90 and 91, at 15 feet, thence 31 feet more, making a total distance of 46 feet, to the place of BEGINNING. PARCEL NO. TWO (2): All that certain lot, piece, or parcel of land situate in the City of Huntington, Cabell County, West Virginia, known and designated on that certain revised Map of Roland Park, made by Edward B. Raiguel, Consulting Engineer, which Map was filed in the Office of the Clerk of the County Commission of Cabell County, West Virginia, on the 20th day of October, 1925, and recorded in Map Book No. 3, at Page 32, of LOT NO. 92, bounded and described as follows: BEGINNING at a stake in the South line of a circle at the Westerly end of Kings Highway, said beginning point being a corner common to Lots 92 and 93, thence from the said beginning and with the dividing line between Lots 92 and 93, South 29 35' West 121.21 feet to a stake, a corner common to Lots 92, 93,106 and 107, thence with the back line of Lot 107, 108, and 109, North 30 40' West 120 feet to a stake, a corner common to Lots No. 91, 92, 109, 110, thence with the dividing line between Lots No. 91 and 92, North 73 24' East 102.82 feet to a stake in the Westerly line of said circle at the Westerly end of Kings Highway, thence with the said line curving to the left on the arc of a circle with a radius of 35 feet, for a distance of 31 feet to the place of BEGINNING. Being the same property conveyed to Elena M. Ermolaeva by the Deed dated July 26, 2005 and recorded in Deed Book 1144, at Page 173 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
